This agreement is made and entered into this ____ day of _________ 20___ by and between, MOON CREEK LABRADORS (Seller) and _______________________________ (Purchaser), for the purpose of setting forth the terms and conditions of the purchase of:

The purchaser agrees to purchase the dog described above as a “companion” for the purchase price of $___________ and subject to the following terms.
MOON CREEK LABRADORS has determined that the dog is of "Pet Quality" and is NOT to be used for breeding. This dog will be registered with AKC Limited Registration. All dogs at MOON CREEK LABRADORS have been micro-chipped and those numbers are kept in our records for positive medical identification.
Permanent ownership of this dog is contingent upon Purchaser’s compliance with this Agreement. Upon our receipt of this dog’s proof of spay/neuter from a licensed veterinarian, Purchaser will then be supplied with a letter of permanent transfer of ownership.
Purchaser agrees to have this dog spayed/neutered no earlier that 24 months of age on_____________. Purchaser understands that this spay/neuter contract is an agreement that this dog will not produce a litter of puppies either as purposely bred or by accidental breeding. Accidental breeding is considered neglect and the dog and puppies will be returned to MOON CREEK LABRADORS at Purchaser’s expense. All puppies born from any breeding, accidental or otherwise, will become the property of MOON CREEK LABRADORS.
It is the responsibility of the PURCHASER, NOT the veterinarian, to ensure that MOON CREEK LABRADORS has received verification that the spay/neuter has been performed. Proof of spay/neuter surgery must be received by MOON CREEK LABRADORS no later than 14 days after the procedure or the date specified above; whichever comes first. Proof shall be in the form of a licensed veterinarian’s statement of spay/neuter invoice bill containing verification of the dog’s microchip number, and the vet's state license number as well as his/her signature for verification.
In the event that the dog's health does not allow this agreement to be honored in the time specified, MOON CREEK LABRADORS must be provided with a statement from a licensed veterinarian stating that this dog is not yet in physical or emotional condition for surgery. Based upon the veterinarian's evaluation of this dog, Purchaser will contact the veterinarian and establish the earliest date that the procedure is able to be performed. At that time Purchaser will notify MOON CREEK LABRADORS of this amendment in physical writing at (Moon Creek Labradors, 115 E. Highway 20, Fairfield, Idaho 83327), at which time all other conditions of this agreement will apply and be enforced.

Unfortunately we must include the following:
In the case of the dog’s demise on or before the above listed date, a written statement from a licensed veterinarian must be sent to MOON CREEK LABRADORS, stating that the puppy has indeed passed away, the cause of death, verification of the dog’s microchip number, and the vet's state license number as well as his/her signature for verification. This is an unfortunate, but necessary step.
In a perfect world we would like to have each puppy we place stay in their original purchasing home. However, should the purchaser rehome this dog, Purchaser agrees to contact MOON CREEK LABRADORS, in writing, or email and let MOON CREEK LABRADORS know BEFORE the dog has been placed into a new home. This contract is still Purchaser’s responsibility to enforce in the dog's new home. Should we not receive confirmation of the dog's spaying or neutering by the above listed date, as the original purchaser, Purchaser will be liable for the terms of this contract.
Failure to comply with this agreement by the date above, unless otherwise agreed to and amended in writing, will be considered a breach of the contract. In that event, the dog MUST be returned to MOON CREEK LABRADORS and Purchaser will be responsible for all transportation expenses. Purchaser will not be entitled to financial restitution or compensation of any kind.
Failure to transport the dog back to MOON CREEK LABRADORS will result in the full registration breeding/showing cost due of $4,000.00 additional to the pet/companion price.
In the event this contract must be enforced all court costs and attorney fees will be the responsibility of the purchaser. Purchaser understands that in such case, all necessary court proceedings will be filed and held in the state and county in which the dog was sold and Seller resides.
